Health and nutrition specialist dsm-firmenich has won a patent infringement case against the Canadian company, Mara Renewables Corporation — specifically its UK subsidiary, Algal Omega-3.
The UK High Court has deemed that Algal Omega-3 has utilised dsm-firmenich's processing technology without authorisation, infringing a valid patent centered on high-potency DHA oil development.
dsm's victory in court will protect its intellectual property, enabling the company to exclusively produce highly pure algal DHA oils through its proprietary process.
According to the company, Algal Omega-3 has been infringing dsm's patent since 2017.
“This result confirms our contentions that Mara/AO3 have been unlawfully using dsm-firmenich’s legitimate IP rights," commented Executive VP of Global Marketing and Business Development at dsm-firmenich, Francois Scheffler.
"We now intend to pursue a full recovery for the damages we have suffered on account of the infringement, and remain even more committed to further defending and enforcing our IP rights in the UK and elsewhere,”
